Mediation Services -> Preparing for Mediation

If you are thinking about mediation, or have a mediation scheduled, here are some things we've found useful for people to do to prepare for mediation.

  • Think about what you want the other person to understand about your perspective on the dispute, and what would need to happen in order for you to feel that the dispute has been resolved. Write down the main issues that you want to address.
  • Think about what the other person wants in order to settle the dispute. Ask yourself if you are willing to try to address his or her concerns.
  • Arrive at your mediation session on time and well rested, and having had something to eat. We'll provide water, tea, and coffee.
  • If you have any special needs, let the DRC know in advance. Our office is wheelchair accessible, and we can arrange for interpreters.
  • Prepare to mediate in good faith. This means:
    • Being willing to share all important information
    • Being willing to listen to the other person with an open mind
    • Being willing to consider moving from your original position on how the dispute should be resolved and consider alternative solutions
    • Being willing and able to keep any agreements that you make
It isn't necessary to bring witnesses or legal counsel to mediation – mediation is not a trial or a hearing. You are encouraged to seek legal review of your settlement agreement if this seems appropriate to you.
